Terms of Service

1. Acceptance of Terms
By creating an account or using Access Point ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
We may update these Terms from time to time. We will notify users of material changes through the platform. Continued use of the Service after an update constitutes acceptance of the revised Terms.
2. Eligibility
The Service is for users who are 18 years of age or older. By registering, you represent and warrant that you meet this requirement. Age compliance is self-attested at registration. If we discover that a user is under 18, we will suspend their account and remove their data to the extent practicable.
If you are a parent or guardian who believes a minor has registered, please contact us immediately.
3. Account Registration and Security
- You must provide accurate account information and keep it up to date.
- You are responsible for maintaining the security of your credentials.
- You must not share your account or allow others to access it on your behalf.
- You must notify us promptly of any suspected unauthorized access to your account.
- Email verification is required before you can access certain features.
- We reserve the right to require an invitation to register, at our discretion.
4. Acceptable Use
You agree not to use the Service to:
- Post, transmit, or solicit content that is unlawful, abusive, defamatory, harassing, threatening, obscene, fraudulent, or discriminatory.
- Impersonate another person or misrepresent your identity or affiliation.
- Scrape, crawl, or systematically harvest data from the Service without our written permission.
- Attempt to gain unauthorized access to any part of the Service or other users' accounts.
- Use automated tools to create accounts, submit listings, or send messages.
- Post false, misleading, or deceptive listings, bids, or job postings.
- Facilitate, solicit, or engage in money laundering, fraud, or illegal transactions.
- Interfere with or circumvent the technical protection measures of the Service.
- Transmit malware, viruses, or any other malicious code through the Service.
- Use the Service in any way that violates applicable law.
5. Content You Post
You are solely responsible for all content you submit to the Service ("User Content"), including listings, messages, job postings, bids, reviews, and profile information.
By posting User Content, you grant Access Point a non-exclusive, worldwide, royalty-free license to store, display, and distribute that content solely as necessary to operate the Service.
You represent and warrant that your User Content does not infringe any third-party rights and does not violate these Terms or applicable law.
We do not claim ownership of your User Content. We may remove content that violates these Terms or that we are required to remove by law.
6. Marketplace, Auctions, and Job Listings
Access Point is a platform for connecting buyers, sellers, traders, and workers. We are not a party to any transaction.
- No payments on platform. Access Point does not process, facilitate, hold, or escrow any payments. All financial arrangements occur entirely off-platform between users.
- No auctioneer. Access Point is not an auctioneer or licensed auction house. Auction listings and bids are conducted between users. Access Point records bids and identifies a winning bidder but has no legal role in any resulting transaction.
- No employer or staffing agency. Access Point does not employ users, broker employment agreements, or act as an intermediary for hired work. Job postings connect parties; Access Point is not responsible for any resulting employment or contractor relationship.
- No broker or escrow. Access Point has no role in negotiating, guaranteeing, or settling any transaction between users.
- Transactions are your risk. You assume all risk in any transaction arranged through the Service. Exercise appropriate due diligence before exchanging money, goods, or services.
- Listing accuracy. Users are responsible for the accuracy of their listings. Access Point does not verify item condition, pricing, job availability, qualifications, or any other listing claim.
7. Accessibility Resources and Listings
Resources, tools, services, and recommendations listed on Access Point are submitted by users and have not been independently verified by Access Point. We make no representation as to the accuracy, completeness, legality, safety, effectiveness, or suitability of any accessibility resource or service listed on the platform.
You are responsible for evaluating whether any resource, tool, or service is appropriate for your specific needs. Nothing on Access Point constitutes medical, therapeutic, legal, or professional advice.
8. Third-Party Links
Listings, resource entries, profiles, and messages may contain links to external websites or services. Access Point does not control, endorse, or take responsibility for the content, privacy practices, or availability of any third-party site. Accessing external links is at your own risk.
9. Trust Scores
The Service displays a trust score for each user based on platform activity. Trust scores are informational estimates only. They do not constitute endorsements, background checks, identity verification, or guarantees of user conduct or reliability. Do not rely on a trust score as a substitute for your own judgment.
10. Messaging
Messaging on Access Point is limited to threads tied to specific requests. Messages are encrypted at rest on our servers but are not end-to-end encrypted — the platform can decrypt them where necessary for abuse investigations, legal compliance, or safety. Do not send sensitive personal information — such as financial account details, government identification, or passwords — through the messaging system.
Messages may be accessed by our team in connection with abuse investigations, legal compliance, safety concerns, or platform integrity. See Section 13 for details.
11. Moderation and Enforcement
We reserve the right, but assume no obligation, to:
- Review reported content or accounts.
- Issue warnings, hide, remove, or restore listings or content.
- Suspend or permanently terminate accounts.
- Report illegal activity to law enforcement.
Moderation actions are taken at our discretion. Where practicable, we will notify affected users when action is taken against their content or account. Moderation records are retained internally.
To report abuse, harmful content, or policy violations, use the contact details in Section 18.
12. Account Suspension and Termination
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if required to do so by law.
Self-service deletion. You may permanently delete your own account at any time from Profile Settings → Delete account. Deletion is immediate and irreversible. See the Privacy Policy for a full description of what is deleted and what is anonymized. If you cannot access your account, contact us and we will process your request manually.
Your data rights. If you are located in the UK or European Economic Area, you have rights under the GDPR including the right of access, rectification, restriction of processing, data portability, and erasure. To exercise any of these rights, use the self-service tools in your account settings or contact us using the details in Section 18. We will respond within the timeframes required by applicable law.
Certain data — including moderation records and anonymized audit entries — may be retained after account closure for administrative accountability, legal compliance, or safety purposes, as described in the Privacy Policy.
13. Data Access and Legal Compliance
We may access account data, content, and records as necessary to:
- Investigate reported abuse, fraud, or violations of these Terms.
- Respond to lawful legal process, including subpoenas, court orders, and government requests.
- Protect the safety of users or the public.
- Maintain the security and integrity of the Service.
We do not sell user data to third parties for advertising or marketing purposes.
14. Intellectual Property
Access Point's name, logo, design, and platform content are owned by or licensed to Access Point and are protected by applicable intellectual property law. You may not copy, reproduce, distribute, or create derivative works from our platform without written permission.
15. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Access Point AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Without limiting the above, Access Point is not liable for:
- Disputes between users arising from marketplace transactions, job arrangements, or auctions.
- Loss resulting from reliance on trust scores, listing accuracy, or accessibility resource information.
- Actions taken by third parties reachable through links posted on the Service.
- Loss or corruption of data.
16. Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
17. General
Governing law. These Terms are governed by applicable law without regard to conflict-of-law principles.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Access Point regarding your use of the Service and supersede any prior agreements.
